Dispute Resolution FAQs

Contract Disputes

Contract disputes often stem from a breach of contract, where one party fails to fulfill their promised obligations. However, situations may arise where disputes emerge even when both parties have made efforts to comply. These disagreements can revolve around the interpretation of the contract or the identification of documents encompassing the agreement. Our expertise extends across a diverse spectrum, encompassing contract disputes of varying magnitudes and across different industries, including handling interstate conflicts.

Negligence

When there's a foreseeable risk of harm, it becomes imperative for a party to uphold a duty of care, ensuring that reasonable precautions are in place to prevent such harm. This responsibility commonly manifests in commercial settings, where individuals are obligated to demonstrate the due skill and care expected of a competent tradesperson or professional during their work. However, this duty extends across a wide array of scenarios. Our legal experts bring extensive experience in handling a diverse range of negligence claims, spanning from issues of defective workmanship to incidents involving cranes toppling over or vehicles colliding with storefronts.

Trade Practices / Consumer Protection / Sale of Goods

The Australian Consumer Law replaced the Trade Practices Act 1974 in 2011. In essence, these laws, along with similarly worded State legislation, prohibit businesses from participating in misleading and deceptive conduct or making false representations. Additionally, the legislation provides consumers with a comprehensive set of statutory warranties that cannot be waived through contracts. This implies that these warranties may still be applicable even if a business asserts there is no warranty or other protections. Our expertise encompasses a wide range of consumer protection claims, spanning from domestic products to financial services.
